Description of Service

beDuck is a platform that provides a map and list-based browser for outdoor activities and events. The App allows users to discover locations (activities) and time-bound events.

Section 2

Assumption of Risk and Specific Exemption of Liability

2.1 Nature of Outdoor Activities

The App catalogs activities such as trekking, motorcycle routes, and excursions. You acknowledge that these activities are inherently dangerous and involve risks of serious injury, death, or property damage.

2.2 Disclaimer of Accuracy

Information provided in the App, including coordinates, route descriptions, meetings, and GPX files, is for discovery purposes only. beDuck does not warrant that any "Plan" is safe, accessible, or accurately described. You are solely responsible for verifying local conditions, weather, and your own physical fitness before undertaking any plan.

2.3 Exemption for Self-Damage or Third-Party Damage

beDuck and its owners shall not be held liable for any:

• Personal injury or death (self-damage) occurring during the realization of a Plan.
• Damage to your personal property (e.g., vehicles, equipment).
• Damage caused by you to third parties or private property while visiting a location discovered through the App.
• Legal infractions (e.g., trespassing) committed while following a route or visiting a site listed in the App.

2.4 Misleading Information

You agree that beDuck is not responsible for misleading, outdated, or incorrect information provided by other users or curated by the App. Information in the "Discovery Compass" is generated via algorithms and may not reflect the actual state of the world.

Section 3

Community Meet and Social Interaction Coordination

The "Community Meet" feature allows users to coordinate group outings.

• Independent Interaction: beDuck provides the coordination tool, "meets," but does not organize, supervise, or vet the individuals who join these meets.
• Personal Safety: You choose to meet with strangers at your own risk. beDuck is not liable for any harassment, criminal activity, or disputes arising from "community meet" interactions.
• Calendar Export: Exporting a meet to your device calendar is a convenience feature; beDuck is not responsible for scheduling conflicts or missed events.

Section 4

Location Data and Privacy

The App uses IP-based location services to sort results by distance.

• Storage: Location is stored only in your device's memory and is never written to the beDuck database.
• Accuracy: Location sorting depends on third-party services (Cloudflare) or user-selected location; beDuck is not responsible for location inaccuracies that lead to misleading distance filters.

Section 5

User-Generated Content and Submissions

The App allows registered users to propose new "Plans" (activities or events).

• Review Process: All submissions enter a review queue and require Admin approval before becoming visible to the public.
• No Guarantee of Accuracy: While beDuck performs a review for quality, we do not verify the real-time safety, legality, or accessibility of the submitted locations.
• Attribution: Your unique username will be publicly associated with any plan you submit.

Section 6

User Conduct and Account Security

• Usernames: You are assigned an auto-generated username which can be changed only once. You may not use usernames that are offensive or impersonate others (individuals or companies).
• Ratings and Reviews: You agree to provide honest, non-malicious ratings. Abuse of the rating system may lead to account termination.

Section 7

External Links and Map Services

The App utilizes the OpenStreetMap plugin and may provide "View Directions" links to external navigation software. beDuck is not responsible for the functionality or safety of these third-party services.

Section 8

Governing Law

These Terms are governed by the laws of Spain. Any disputes arising from the use of the App or these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

Section 9

Modifications to Service

beDuck reserves the right to change plan statuses (e.g., concluding or declining plans) or modify the availability of features like the "Discovery Compass" at any time without notice.
